If you are in the position of looking for a divorce lawyer then there are steps you need to take; certain qualities are necessary, the most important are listed below: Fully qualified to deal with your case Have the right disposition Be trustworthy Whilst it is nice to know your attorney is good in divorce battles it will be to your advantage to choose one with a good mediation record. Still, you also need to feel at ease with them; someone who immediately instills a sense of trust. Adversarial attorneys will use the hammer to crack a walnut approach which often happens when these cases go to court whereas an attorney who specializes in mediation will take a much calmer approach. Some of the work load will be yours so you need to ensure you are well prepared each time you speak with your divorce lawyer and know exactly what they need from you and vice versa. Costs are always an issue so write down everything you want to ask and in a logical order always making sure there is an accurate record of times dates and the duration of conversations. Try to keep actual meetings to a minimum and where points have to be clarified, use the phone or send a letter. Remember your divorce attorney is there for their expertise in the field and not to act as a counselor, you should hopefully be able to use people close to you for that. Unless you actually want your divorce lawyer to do something about your spouse's behavior or actions, do not use them for general complaints as it is costly and probably won't achieve anything. Let your lawyer know from the start that you will be in charge of the case and they are there for legal advice and not as someone to lean on when things start getting rough. Tell them you want good advice and will rely on their experience, but that you expect to make decisions that concern the tone and strategy of the case. Ask that you be sent copies of all documents and letters and let them know that you expect phone calls to be answered by the next working day, after all you are the one paying the bills. If money is an issue, it may be a preferable for you to only contact a lawyer for legal advice on a marital settlement but not representation. This means that a little research is necessary on your part but once you have completed this, it is much easier to contact a lawyer to ask them specific questions and how they see your case concluding. If the break up is relatively amicable then a marital settlement might be the better option and the use of a divorce lawyer could be restricted to just help with this task.
