If you have a disability you might find yourself appealing for social security disability benefits you deserve. The US Social Security system considers your eligibility, the amount your claim and the circumstances when you apply for SSDI benefits.

If your application is rejected, you can then begin a process of appeal to have the decision reconsidered. In order to start the social security disability appeal process, you will have to send the organization a letter of appeal no more than 60 days after receiving the original letter of rejection.

Understanding Social Security

The United States social security system can be easily explained in relatively simple terms.

The Social Security act affects the entire working population of the United States, including employer, employees, and the self-employed. Each working individual must contribute a certain amount from their personal pay checks to social security in the form of tax.

The Social Security system is a safety net that many people use to protect themselves. Benefits like retirement benefits, survivor benefits and disability benefits provide people with the money they need when life makes it impossible to continue to work as usual.

A large number of American citizens wish to use the Social Security system to provide their families with a greater degree of financial security. Benefit payments can be classified in a number of ways, such as survivor's benefits, retirement benefits, and disability benefits.

Social Security payments are only granted to individuals who have held a job or were self-employed. You must also pay your taxes in order to qualify for Social Security benefit payments in the future.

Retirees need a specific number of work credits to be eligible. The number of credits necessary depends on the person's age and the demographics of the area they are from.

Social Security Appeal Process

If you have been denied disability benefits you must send in a Request for Reconsideration.

If the reconsideration is denied, you can appeal in a hearing before an Administrative Law Judge.

If this should also fail, the appeal can then be forwarded upward to the Social Security Appeal Council (SSAC) which will then evaluate the accuracy of the ALJ's decision and determine the appropriate course of action.

If the decision does not favor the claimant, then he or she can apply for a Federal Court review.

It is recommended that the appeal process be handled by a social security disability lawyer, who typically works on a contingency basis, to have the best chances of receiving claims. Contrary to myths about the process, a large percentage of people do win their cases after the initial rejection.

So do handle the social security disability appeal process as early as possible, because it takes months of waiting, and get a good lawyer who works exclusively in this arena.
